COPYRIGHT
How the copyright works is that Fairfield City Council own the actual photographs so can exhibit them but not copy them.
Council Libraries purchased the physical prints only. The negatives and copyright are retained by Fairfax Archives (Nine Media) in all instances where the images were taken by staff photographers for The Sydney Morning Herald, The Sun or The National Times.
As there is no manifest, Nine Media would need to consult their digital archive or their negatives catalogue to confirm copyright ownership for individual prints. Please be aware, this can be a time-consuming process and it may attract a research fee.
For images that do not belong to Nine Media, the library will need to assume responsibility for clearing copyright with the photographer or their next of kin. Nine Media no longer have contact details to assist with this process.
The Council Libraries are permitted to:
• scan the images for preservation and internal research purposes only;
• publish these scans in library magazines and annual reports;
• display the hard-copy prints in library exhibitions.
The Council Libraries must seek a licence for all other types of usage, including but not limited to:
• social media
• marketing
• merchandise
• books, articles and other publications, excepting library magazines and annual reports
• broadcast
• web display.
Must credit Nine Media images to the photographer (when known) and masthead in accordance with the following format: John Smith/The Sydney Morning Herald.
Please send all third-party requests for these images to the Syndication department at Fairfax Archives (Nine Media). They will manage these requests as part of their day-to-day operations.
